REGULATION OF THE WEBSITE www.ebuy-safe.com
Online Store www.ebuy-safe.com is conducted by AGROMARKET POLSKA COMPANY WITH LIMITED RESPONSIBILITY, ul. General Stanisława Skalski 3 / 11, 20-291 Lublin, NIP: 9462759586, e-mail: contact@ebuy-safe.com, hereinafter: "Seller".
§ 1. GENERAL PROVISIONS AND DEFINITIONS
These Terms and Conditions lay down the rules for the use of the Online Shop, the placing of orders, the delivery of Products, payments, complaints and withdrawal from the contract.
The terms used in the Rules of Procedure mean:
Buyer – natural person, legal person or organisational unit ordering in the Shop;
Consumer – consumer within the meaning of Article 221 the Civil Code and the person referred to in Article 38a of the Consumer Rights Act;
An individual trader – a natural person who enters into a contract directly related to his or her economic activity but who is not of a professional nature;
Product / Goods – moving item offered at the Store;
Order – a declaration of the Buyer's will to conclude a sales agreement;
Sales contract – distance contract between the Buyer and the Seller;
Account – individual panel of the Buyer in the Store;
Price – gross price of the Product, including VAT, without delivery costs, unless otherwise specified;
Working day — Monday to Friday, excluding public holidays;
Proof of purchase – fiscal receipt, VAT invoice or electronic receipt.
Detailed rules for the processing of personal data are set out in the Privacy Policy available on the Shop website.
§ 2. TECHNICAL REQUIREMENTS
To use the Online Shop are required:
Internet access and active e-mail box;
current web browser, in particular Chrome, Firefox, Safari or Edge, with JavaScript enabled and cookie support;
software for reading PDF files.
§ 3. CONTRIBUTION OF CONTRACTS
Buyer can submit orders 24 hours a day, 7 days a week – with or without an Account.
Submission of the Contract requires:
adding Product to Cart;
filling out the Order Form and providing the data necessary for the performance of the Order;
acceptance of these Rules of Procedure;
Send Orders to the Store.
Orders placed on the working days after 3:30 p.m. and on Saturdays, Sundays and public holidays will be considered on the next working day.
Confirmation of the submission and acceptance of the Order for implementation will be sent to the Buyer by e-mail. The Agreement shall be deemed to have been concluded upon receipt of this message by the Buyer.
Orders submitted for execution may be amended or cancelled by the Buyer until the Product is dispatched. Any changes are possible by email contacting: contact@ebuy-safe.com. Any change may affect the time of performance of the Order.
In the absence of availability of a given Product, the Buyer will be informed and may: agree to extend the deadline for completion, opt out of the missing Product or cancel the entire Order.
The seller has the right to cancel the order if the Buyer does not complete the missing data within 7 calendar days of the request.
§ 4. PAYMENTS
Depending on the Buyer's choice, you can pay for your order as follows:
via the Transfer Platform24;
payment card: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro;
traditional bank transfer to the Seller.
The online payment service provider is PayPro S.A., the service operator Przelewy24, ul. Pastelowa 8, 60-198 Poznań, entered on the Register of Entrepreneurs of the National Court of Poznań – Nowe Miasto and Wilda in Poznań, VIII KRS Economic Division under KRS number: 0000347935, NIP: 7792369887, REGON: 301345862.
Data for transfer and payment details are sent to the Buyer in an e-mail confirming the Order.
In case of selection of payments by traditional transfer, electronic payment or payment card implementation Contracts shall be started as from the date on which the bank account is recognised. The seller either after receiving confirmation of the correct payment from the operator.
Where reimbursement is necessary for a transaction made by a payment card, The seller will make a refund to the bank account assigned to the Buyer's payment card.
The sale is documented by an electronic receipt or, at the Buyer's request, by a VAT invoice.
§ 5. SUPPLY
Buyers can receive ordered Products through courier companies. The address of delivery of the consignment shall be provided by the Buyer when submitting the Order.
Delivery costs shall be borne by the Buyer. These costs depend on the type, size and weight of the consignment and the place of delivery. The final amount of delivery costs is visible when the Order is submitted.
Supply within the European Union shall not be subject to a customs duty. In the case of supplies to non-EU countries, any customs, tax and other administrative duties shall be borne by the Buyer.
Estimated delivery time, counted from the moment of its release to the courier company:
up to 2 working days – in the territory of the Republic of Poland;
up to 7 working days – deliveries within the European Union;
up to 14 working days – deliveries outside the European Union, unless otherwise specified individually.
The buyer undertakes to collect the ordered Product.
§ 6. RELAMATION FOR DISTORTION OF TRANSMISSION
After signing the consignment note, purchasers who are not Consumers are obliged to check the contents of the consignment in the presence of a courier. The courier is obliged to wait until this is done.
In the event of a defect or damage to the Product, a damage report shall be drawn up without delay, which shall form the basis for the complaint.
If the courier refuses to wait to check the shipment, The buyer is obliged to report the damage to the transport company on the day of receipt of the consignment.
Before signing the minutes the Buyer should check its contents and make sure that the data contained in it is in accordance with the facts. In addition, it is recommended to take photographs of the damaged Product and/or packaging.
The completed damage protocol should be sent electronically to the e-mail address: contact@ebuy-safe.com.
Advertised Product must be returned to the address of the Vendor:

§ 7. RECLAIMS FOR NON-CONFORMITY OF GOODS WITH THE AGREEMENT
The consumer is entitled to the incompatibility of the goods with the contract under the terms of the Consumer Rights Act of 30 May 2014 implementing the Goods Directive 2019/771. The consumer may request in particular: repair of the Product, replacement of the Product, reduction of the price or withdrawal from the contract.
If it is found that the Product is defective, the Buyer is obliged to inform the Vendor.
Complaints should include: description of the defect of the Product, date of notice of the defect and request of the Buyer, e.g. repair, exchange, price reduction or withdrawal from the contract.
The complaint can be submitted by e-mail to: contact@ebuy-safe.com, in writing or via the complaint form available in Annex 1 to these Rules. The use of the form is not compulsory.
It is recommended to include the Proof of purchase, i.e. receipt or invoice, or a copy of it.
Advertised Product must be returned to the address of the Vendor:

with order number, e-mail address and description of the application.
The seller undertakes to respond to the complaint within 14 calendar days. The absence of a reply within that time limit means that the complaint has been found reasonable.
In the case of non-Consumer Buyers, the liability of the Seller under the warranty is completely excluded.
§ 8. RIGHT OF WITHDRAWAL FROM THE AGREEMENT
Buyer who is a Consumer or an individual entrepreneur has the right to withdraw from the distance sale contract via the Online Store www.ebuy-safe.com, without giving a reason, within 14 days of the date of possession of the goods.
The period for withdrawal shall begin:
for a contract for the sale of a single commodity, from the date on which the Consumer or a third party designated by him, other than the carrier, took possession of it;
in the case of a contract covering a number of things, from the date of taking possession of the last commodity, lot or part;
in the case of a contract for the regular delivery of goods over time, from taking possession of the first of the things.
In order to exercise the right of withdrawal, the Consumer may:

use the electronic return form available on the Shop website.
The seller shall immediately, on a durable medium, e.g. by e-mail, confirm receipt of the withdrawal declaration. In the event of effective withdrawal, it shall be deemed not to have been concluded.
The consumer shall bear the direct costs of returning the goods, unless the Seller has offered to receive them at his own expense.
The seller shall reimburse all payments made by the Consumer, including delivery costs up to the lowest delivery method offered, within no later than 14 days of receipt of the withdrawal declaration.
Payment will be reimbursed using the same method of payment used by the Consumer, unless he agrees to another method.
The seller may withhold the refund until he receives the returned goods or provides proof of the return of the goods, whichever is the earlier.
The consumer shall return the goods immediately, no later than 14 days from the date on which he informed the consumer of the withdrawal. The time limit shall be deemed to be complied with if the goods are returned before their expiry.
The consumer shall be responsible for reducing the value of the goods if they result in the use of them in a way that goes beyond what is necessary to establish their character, characteristics and functioning.
§ 9. EXCEPTIONS FROM THE RIGHT OF WITHDRAWAL FROM THE AGREEMENT
The right of withdrawal from a distance contract shall not be granted in the cases referred to in Article 38 of the Consumer Rights Act of 30 May 2014, in particular as regards contracts:
in which the subject of the benefit is a non-prefabricated product, manufactured according to the specifications of the Consumer or intended to satisfy his individualised needs;
where goods which are perishable or which have a short period of use are the subject of benefits;
where the goods are supplied in sealed packaging which, after opening, cannot be returned for health or hygiene reasons if the packaging has been opened after delivery;
in which the goods, after delivery, by their nature, are inseparably combined with other goods;
the provision of digital content not supplied on a material medium, if the provision started with the express consent of the Consumer before the expiry of the period of withdrawal and after being informed of the loss of the right of withdrawal;
to provide journals, periodicals or periodicals, except for subscription agreements.
§ 10. PROTECTION OF PERSONAL DATA
The administrator of personal data of the Buyer is the Seller – AGROMARKET POLSKA COMPANY WITH LIMITED RESPONSIBILITY, ul. General Stanisława Skalski 3 / 11, 20-291 Lublin, NIP: 9462759586.
Personal data of the Buyer are processed in accordance with the Regulation of the European Parliament and of the Council 2016/679 of 27 April 2016, called GDPR, and other applicable laws.
Detailed information on the rules and purposes of the processing of personal data, the rights of the Buyer and how to exercise these rights can be found in the Privacy Policy available on the Website www.ebuy-safe.com.
The Buyer has the right to inspect, correct, delete and restrict the processing of the data, as well as to transfer the data and lodge a complaint with the President of the Office for Personal Data Protection.
In order to complete the payment, personal data of the Buyer, such as name, e-mail address and IP address, are made available to the Payment Operator – PayPro S.A., Pastelowa 8, 60-198 Poznań – as a separate personal data controller. The rules for data processing by PayPro S.A. are laid down in the Przelewy24 website regulations.
§ 11. PROTECTION OF AUTHOR RIGHTS
All materials on the website of the Online Shop, in particular photographs of Products, texts, graphics, logos and other elements, are property Sellers or were used with the consent of third parties having copyright to them.
Copy, distribute, reprint, make available and any use of graphic and text materials without prior written consent Sellers or third parties entitled shall be prohibited.
RESPONSIBILITY
The seller shall not be liable for: the inaccessibility of the Store caused by force majeure; actions or omissions of the Buyer and third parties; blocking or deleting e-mail messages resulting from the operation of postal server administrators; technical problems arising from the Buyer's equipment; errors in the performance of the order resulting from the supply of incorrect or incomplete data by the Buyer.
The Seller reserves the right to impose restrictions, temporarily suspend or terminate the provision of Online Store services due to maintenance work. The interruptions in the provision of services will be without prejudice to the rights of the Buyer.
§ 13. FINAL PROVISIONS
The Seller reserves the right to change these Terms and Conditions for important reasons, such as changes to laws, offers, data or functionality. The changes shall enter into force no earlier than 14 calendar days after their publication on the Website and inform the Buyers holding the Account by e-mail.
Contracts placed before the date of entry into force of the amendments shall be executed on the basis of the rules in force at the time of the submission of the contract.
All disputes will be settled first in an amicable way. The consumer has the right to use out-of-court methods of handling complaints and redress, including the ODR platform available at: https://ec.europa.eu/consumers/opr/.
In matters not governed by these Regulations, the relevant provisions of the law of general application, in particular the Civil Code and the Consumer Rights Act, shall apply.
